The UK doesn't ask a foreigner for permission to buy — it charges a premium for it instead. The gap between the final cost for a local first-time buyer and a non-resident buying a second property isn't measured in percentage points — it's measured in multiples of the tax bill.

Stamp duty and three layers of surcharge

The core transaction tax is Stamp Duty Land Tax (SDLT in England and Northern Ireland; Scotland and Wales run their own equivalents with their own bands). It's calculated on a progressive scale based on the property price, and surcharges can stack on top of the base band.

  • Non-resident surcharge. A buyer who doesn't spend enough days in the UK pays extra percentage points on top of the standard rate.
  • Additional-property surcharge. If the property being bought isn't the buyer's only one worldwide, a second surcharge applies; its rate has been raised in recent years.
  • Buying through a company. Residential property above a set threshold bought by a corporate entity is hit with a single elevated flat rate — buying “through a structure” makes the deal more expensive here, not cheaper.

The surcharges stack, so the final figure comes from the full combination, not a single rate off a table. Non-resident status is assessed by days spent in the country around the transaction date; if status later changes, a surcharge refund is possible, and that's a separate process with its own deadline.

Annual tax for companies

Residential property above a set value held by a company is subject to the Annual Tax on Enveloped Dwellings. Reliefs exist — for example, for property let to third parties on commercial terms — but a return still needs to be filed regardless, and failing to file triggers a penalty on its own.

Holding and renting

  • Council tax — a local charge depending on the property band and area; many councils charge a premium on long-term empty homes.
  • A non-resident's rental income is taxed in the UK. By default the agent or tenant withholds tax at source; the owner can apply to receive payments without withholding and file independently instead.
  • Mortgage interest relief for individual landlords is capped — this reform has significantly reshaped the economics of private rental in the country.

Selling: capital gains tax and the 60-day window

Non-residents pay capital gains tax on the sale of UK property — the regime covers all property, not just residential. The key practical detail: the sale must be reported and the tax paid within a tight window after completion — around two months — and it's a standalone obligation, not covered by the annual tax return. Missing the deadline is penalised.

Practical takeaway

  • Price the whole transaction. The base band plus two surcharges is a substantial share of the price, and it's due immediately.
  • Don't default to buying through a company. In the UK, corporate ownership of housing costs more, both at purchase and every year after.
