Birth as a route to citizenship: Argentina, Chile and the first reversals

A number of countries in the Americas grant citizenship by birth on the territory, unconditionally or nearly so. In several, the parents of a citizen child gain an accelerated route to residence and naturalisation. Both halves of that arrangement have come under pressure.

How it worked

• The child acquires citizenship at birth, with a passport issued in weeks.
• The parents apply for residence as the parents of a national, and for naturalisation on a shortened period.
• Argentina and Brazil were the most used; Chile, Mexico and others have their own variants with different conditions.

What changed

• Chile has long excluded children of transient foreigners from automatic citizenship, and administrative practice around who counts as transient has tightened.
• Argentina moved to restrict the arrangement: measures introduced in 2025 tightened residence and naturalisation requirements and targeted the practice of arriving specifically to give birth, including proposals to require lawful residence rather than mere presence for the parents' derived rights.
• Reversals have begun. Cases of citizenships and residences granted on the back of birth arrangements being reviewed and annulled have appeared, particularly where documents or presence were misrepresented.
• The United States is a separate and much-discussed case whose position has been the subject of executive action and litigation; anyone relying on it should take current legal advice rather than any general statement.

The medical and practical reality

The arrangement involves a late-pregnancy international flight, a foreign healthcare system, a language you may not speak, and insurance that frequently excludes maternity for new policies. Facilitators marketing it rarely address any of that, and the cases that go wrong go wrong medically rather than legally.

The assessment

Where the family genuinely lives in the country, a child born there acquiring citizenship is an ordinary and unproblematic outcome. Where the trip exists for the document, the arrangement is now a declining asset: restricted in more places each year, reviewable retrospectively, and dependent on a state's tolerance for a practice it has begun to describe as abuse.
